Estate Planning Advice in Sydney

Plan how your financial affairs, superannuation and other assets work alongside your estate planning documents. We coordinate the financial planning aspects of your estate plan and work with your solicitor and accountant where specialist legal or tax advice is required.

Bringing your financial plan and estate plan together

Estate planning is about making sure your financial affairs and legal documents work together so your wishes can be carried out as intended.

Your will is an important part of the process, but not every asset is necessarily dealt with by your will. Superannuation, jointly held assets, trusts, companies and insurance can each have their own rules and structures that need to be considered as part of the broader plan.

Private Capital Management focuses on the financial planning aspects of estate planning. We review how relevant assets are held, consider superannuation nominations and insurance arrangements, and identify financial or structural issues that should be addressed with your solicitor or accountant.

We can work directly with your existing solicitor and accountant so the financial strategy and legal documents are coordinated. Where you do not already have the appropriate professional adviser, we can work with suitable specialists as part of the process.

Your estate planning arrangements should also be reviewed when your circumstances change, including marriage, separation, the birth of a child, changes to your business or financial position, or the death of someone important to your existing arrangements.

What estate planning advice can cover

  • Your financial position and asset ownership

Review the assets and structures that form part of your financial position and identify how ownership may affect the estate planning strategy.

  • Superannuation nominations

Review superannuation beneficiary nominations and how they fit with your broader estate planning objectives and retirement strategy.

  • Insurance arrangements

Consider relevant insurance ownership and beneficiary arrangements as part of the broader financial plan.

  • Trusts, companies and other structures

Consider how existing structures fit within your financial and estate planning objectives, working with your solicitor and accountant where legal or tax advice is required.

  • Tax and financial considerations

Identify potential financial and tax issues that may arise from the strategy so they can be considered with the appropriate professional advisers before changes are implemented.

  • Professional coordination

Work with your solicitor and accountant to help ensure the financial strategy, asset structures and legal documents are aligned.

  • Ongoing review

Review the financial planning aspects of your estate plan as your family, assets, superannuation, business interests and circumstances change.

Legal documents are prepared by your solicitor

Documents such as your will, enduring power of attorney, enduring guardianship and advance care directive are legal documents and should be prepared by an appropriately qualified legal professional.

Private Capital Management does not draft these legal documents. Our role is to help identify the financial planning issues that need to be considered and to work with your solicitor so the legal documents reflect the broader strategy.

Depending on your circumstances, your solicitor may also advise on matters such as testamentary trusts, guardianship arrangements, business succession and other legal structures. Your accountant or tax adviser may be involved where specialist tax advice is required.

Key components to coordinate

  • Will

Your solicitor prepares your will and advises on how your estate is to be distributed and who will act as executor. We help ensure the financial planning arrangements considered in your advice are coordinated with that legal strategy.

  • Enduring power of attorney

Your solicitor can advise on and prepare an enduring power of attorney for financial and legal decisions if you are unable to make them yourself.

  • Enduring guardianship and advance care planning

Your solicitor can advise on the appropriate documents for health, lifestyle and care decisions. The terminology and requirements can differ between Australian states and territories.

  • Superannuation nominations

Superannuation death benefits are subject to superannuation law, fund rules and any valid beneficiary nomination. We can advise on the financial planning aspects of beneficiary nominations and how they fit with your broader estate plan.

  • Insurance beneficiaries and ownership

Where relevant, we consider how insurance ownership and beneficiary arrangements fit within the broader financial strategy.

  • Trusts and business structures

Where trusts, companies or business interests are involved, we can coordinate the financial planning considerations with your solicitor and accountant.

Common questions about estate planning

  • Do you write my will?

No. Wills and other legal estate planning documents are prepared by your solicitor. Private Capital Management focuses on the financial planning aspects of your estate plan and can work with your solicitor to help coordinate your superannuation, asset structures, insurance and broader financial strategy.

  • Does my superannuation automatically pass under my will?

Not necessarily. Superannuation death benefits are dealt with under superannuation law and the rules of the relevant fund, taking into account any valid beneficiary nomination. We can review your nominations as part of your financial advice and coordinate with your solicitor where the estate planning strategy requires it.

  • Can you work with my existing solicitor and accountant?

Yes. We can work directly with your existing solicitor and accountant so the financial planning, legal and tax aspects of the strategy are considered together. Where you do not already have the appropriate professional adviser, we can work with suitable specialists as part of the process.

  • When should I review my estate planning arrangements?

Your arrangements should be reviewed when there is a significant change in your circumstances, such as marriage, separation, the birth of a child, a death in the family, a business transaction or a material change in your assets or financial position. Periodic review is also important because superannuation nominations, ownership structures and relevant rules can change.

  • Can estate planning form part of my ongoing Wealth Management service?

Yes. Estate planning considerations can form part of your broader Wealth Management strategy. We can review the financial planning aspects over time and coordinate with your legal and tax advisers where changes are required.
